Terms of Service

1. Platform Description

SocietyServe (“Platform”) is a technology marketplace that connects residents (tenants) of apartment communities with verified home service providers, including but not limited to maids, cooks, electricians, carpenters, and plumbers. The Platform is operated within gated apartment societies and facilitated by society administrators.

SocietyServe acts solely as an intermediary platform. We are not an employer of service providers, nor are we a party to any service agreement between tenants and providers. We facilitate discovery, booking, and payment — the actual service relationship exists between the tenant and the provider.

2. User Accounts

  • You must verify your phone number via OTP to create an account.
  • You must provide accurate information including your real name, flat number, and society details.
  • Each individual may maintain only one account on the Platform.
  • Tenants and providers must be approved by their society administrator before accessing Platform features.
  • You are responsible for all activity that occurs under your account.
  • You must not share your account credentials or allow others to access your account.

3. Bookings and Payments

3.1 Booking Process

  • Tenants can book one-time services or subscribe to monthly plans for recurring services (e.g., daily maid, cook).
  • Bookings are confirmed once the provider accepts the request.
  • Unconfirmed bookings are automatically cancelled after 48 hours.
  • Monthly subscription plans auto-renew unless cancelled before the renewal date.

3.2 Payments

  • All payments are processed securely through Razorpay. SocietyServe does not store your complete payment credentials.
  • Payment is collected from the tenant at the time of booking or subscription renewal.
  • Provider earnings are deposited into their in-app wallet and can be withdrawn to their bank account.
  • SocietyServe charges a platform commission on each transaction. The commission rate is displayed before booking confirmation.

3.3 Cancellation and Refunds

  • One-time bookings: Free cancellation up to 4 hours before the scheduled service time. Late cancellations may incur a fee.
  • Monthly subscriptions: Can be cancelled anytime. Service continues until the end of the current billing period. No pro-rata refunds for partial months.
  • Trial bookings: 1-day trials can be cancelled at no charge before the trial day begins.
  • Refund requests for service quality issues must be raised within 24 hours of service completion through the complaint system.

4. Provider Responsibilities

  • Providers must submit valid government-issued ID for verification before offering services.
  • Providers must deliver services as described in their profile and agreed upon during booking.
  • Providers must maintain professional conduct and arrive on time for scheduled services.
  • Providers are responsible for their own tools, supplies, and transportation unless otherwise agreed with the tenant.
  • Providers must not solicit tenants for off-platform bookings to circumvent SocietyServe.
  • Providers are independent contractors, not employees of SocietyServe. Providers are responsible for their own taxes and compliance.

5. Tenant Responsibilities

  • Tenants must make timely payments for booked services and subscriptions.
  • Tenants must treat providers with respect and provide a safe working environment.
  • Tenants must provide accurate service requirements and flat access details at the time of booking.
  • Tenants should provide honest, fair reviews and ratings based on actual service experience.
  • Tenants must not request services that are illegal, unsafe, or outside the scope of the provider's listed services.

6. Platform Commission and Fees

SocietyServe charges a platform commission on transactions to maintain and improve the Platform. The commission structure is as follows:

  • The platform commission percentage is clearly displayed during the booking process.
  • Commission is deducted from the provider's earnings before wallet deposit.
  • SocietyServe reserves the right to modify commission rates with 30 days' prior notice.
  • No additional fees are charged for account creation, browsing, or community features.

7. Community Guidelines

  • Users must not post false, misleading, abusive, or defamatory content on community boards.
  • Spam, harassment, and discrimination are strictly prohibited.
  • Society admins may moderate and remove content that violates these guidelines.
  • Repeated violations may result in account suspension or termination.

8. Dispute Resolution

In the event of a dispute between a tenant and a provider:

  1. Step 1 — File a Complaint: Use the in-app complaint system to report the issue with relevant details.
  2. Step 2 — Society Admin Review: Your society administrator will review the complaint and attempt to mediate a resolution.
  3. Step 3 — SocietyServe Support: If unresolved, escalate to SocietyServe support at support@societyserve.com.
  4. Step 4 — Final Decision: SocietyServe will review the dispute and make a final, binding decision regarding refunds or account actions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Marketplace role only. SocietyServe is a technology platform that facilitates discovery, booking, and payment between independent tenants and independent service providers. We are not an employer, agent, partner, joint venturer, or guarantor of any provider, tenant, or society. We do not perform the services ourselves and do not supervise providers in your home.
  • No liability for service outcomes. SocietyServe is not liable for the quality, timeliness, completeness, suitability, or outcome of any service performed by a provider, including but not limited to delays, no-shows, incomplete work, or damage caused during the course of work.
  • No liability for acts of users. SocietyServe is not liable for any act, omission, conduct, statement, or representation of any tenant, provider, society administrator, visitor, or third party, whether on or off the Platform.
  • Independent verification. While we collect basic identity information from providers, SocietyServe does not perform comprehensive background checks, criminal record verification, or credit checks unless explicitly stated in writing. Tenants are solely responsible for verifying any provider's credentials, references, and suitability before allowing them into their home and for supervising the provider while services are performed.
  • Liability cap. SocietyServe's aggregate liability to any user, for any claim of any nature whatsoever arising out of or in connection with the Platform, shall not exceed the lesser of (a) the platform commission actually retained by SocietyServe from the specific transaction giving rise to the claim, or (b) ₹5,000. This cap applies in aggregate, not per claim.
  • Excluded damages. SocietyServe shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, mental anguish, or emotional distress, even if advised of the possibility of such damages.
  • Force majeure & technical issues. SocietyServe is not liable for service interruptions, payment failures, OTP delays, push notification failures, data loss, or any other event arising from causes beyond our reasonable control, including network outages, third-party service failures, acts of god, strikes, riots, pandemics, or government action.

We strongly recommend that tenants verify provider credentials and supervise services as needed, especially during initial engagements.

9A. Theft, Property Damage, Personal Injury & User Conduct

By using the Platform, you expressly acknowledge and agree that:

9A.1 Theft and missing property

SocietyServe shall not be liable for any theft, loss, misplacement, or disappearance of cash, jewellery, electronics, documents, or any other property of the tenant, provider, society, or any third party, whether such loss occurs before, during, or after a service. Tenants are advised to secure valuables before allowing any service provider into their home. The relationship between the tenant and provider is the relationship between two private individuals, and any criminal complaint must be filed by the affected party directly with the appropriate police authority.

9A.2 Property damage

SocietyServe shall not be liable for any damage to walls, floors, fixtures, appliances, furniture, electronics, plumbing, electrical wiring, or any other property arising from a service, including damage caused by negligence, lack of skill, faulty tools, or use of incorrect materials. Disputes about property damage shall be resolved directly between the tenant and the provider.

9A.3 Personal injury

SocietyServe shall not be liable for any personal injury, illness, infection, or loss of life sustained by any tenant, provider, family member, guest, child, elderly person, domestic worker, or third party in connection with a service. This includes injuries from slips, falls, electric shocks, cuts, burns, food poisoning (in the case of cooks), exposure to chemicals (in the case of cleaning services), or any other cause.

9A.4 Misbehaviour, harassment, and misconduct

SocietyServe shall not be liable for any misbehaviour, rudeness, verbal abuse, harassment (including sexual harassment), discrimination, intimidation, intoxication, theft of personal information, photography without consent, or any other inappropriate conduct by any tenant, provider, society administrator, or third party. While SocietyServe may, at its sole discretion, review reports of such conduct and take action such as suspending or removing accounts, SocietyServe is under no obligation to investigate, mediate, or resolve disputes between users, and any decision to act or not act shall not create a duty of care or liability for future incidents.

9A.5 Criminal acts

SocietyServe shall not be liable for any criminal act, including but not limited to theft, burglary, assault, sexual offences, fraud, cheating, or impersonation, committed by any user. Affected parties shall report such acts directly to the police. SocietyServe will, on receipt of a valid legal request from a competent authority, cooperate by sharing limited account information as required by law, but does not act as an investigator or law-enforcement body.

9A.6 Third parties in the home

Tenants understand that allowing any individual into their home carries inherent risk. By booking a service through SocietyServe, the tenant accepts this risk and waives all claims against SocietyServe arising from the presence of a provider in their home or building.

9A.7 Insurance

SocietyServe does not provide insurance for tenants, providers, property, or services performed. Users are encouraged to maintain their own home, contents, health, and personal accident insurance.

9B. Indemnity

You agree to defend, indemnify, and hold harmless SocietyServe, its founders, directors, employees, contractors, and affiliates from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable legal fees) arising out of or relating to:

  • Your use of the Platform;
  • Your breach of these Terms;
  • Your violation of any law or the rights of any third party;
  • Any service performed, requested, or received through the Platform;
  • Any content you post, share, or transmit through the Platform;
  • Any dispute between you and another user.

SocietyServe reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you shall cooperate fully with our defence.

10. Termination

  • You may delete your account at any time through the app settings. Active subscriptions should be cancelled before account deletion.
  • SocietyServe may suspend or terminate your account for violations of these Terms, fraudulent activity, or harmful behavior.
  • Society admins may revoke a user's approval, which restricts their access to Platform features within that society.
  • Upon termination, any outstanding provider earnings will be settled within 30 days.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the app or via SMS at least 15 days before they take effect. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.
